Call for Applicants / Immigration, Citizenship, and Residency Cases: Citizen Justice

Do you know that the Citizenship of Zimbabwe Act and the Immigration Act is out dated and far behind in terms of alignment with the new Constitution of Zimbabwe?

Do you know, every Zimbabwean citizen and everyone else who is legally in Zimbabwe has the right to move freely with Zimbabwe, reside in any part of Zimbabwe, and to leave Zimbabwe?

Do you know that in terms of the new Constitution, there is supposed to be a new Citizenship and Immigration Board consisting of a chairperson and at least two other members appointed by the President to be responsible for granting and revoking citizenship by registration; permitting persons other than citizens to reside and work in Zimbabwe; and fixing the terms and conditions under which they may so reside and work?

Why then must we still apply for citizenship by registration from the Registrar General’s Department?

Why then must we apply for residence, work, study, and other permits from Linquenda House?

Why has the new law not been passed to reflect the new constitutional dispensation?

After all, the Constitution of Zimbabwe is the supreme law of Zimbabwe and any other law, practice, custom or conduct inconsistent with it is invalid to the extent of the inconsistency. The obligations imposed by the Constitution are binding on every person, natural or juristic, including the State and all executive, legislative, and judicial institutions and agencies of government at every level and must be fulfilled by them.

Kubatana, in partnership with CitizenJustice, will shortly convene a dialogue with potential applicants to the realignment class action where the details of the case to be pursued and other logistical issues will be discussed and agreed upon.
